5.1 As-Is BasisThe Site and all content on it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, Quantum Insurance disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

However, we do not warrant that the Site will be error-free, uninterrupted, or that any content is complete, accurate, or up to date. Coverage details, availability, and pricing are subject to change without notice.

5.3 No Guarantee of OutcomesAny reference to potential outcomes, cost savings, or operational results on this Site reflects general information and is not a guarantee of specific results for any individual or business.

In no event shall our total liability to you for all claims arising out of or relating to your use of the Site exceed one hundred dollars ($100.00) or the amount you paid to us in the twelve months preceding the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

You agree to indemnify, defend, and hold harmless Quantum Insurance, Financial Partners Group, and their respective affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site in violation of these Terms; (b) any information you submit through the Site that is inaccurate, misleading, or fraudulent; or (c) your violation of any applicable law or regulation.

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

9.1 Site ChangesWe reserve the right to modify, suspend, or discontinue the Site or any portion of it at any time without notice or liability.

9.2 Terms ChangesWe may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be communicated through a prominent notice on the Site or by direct communication where required. Your continued use of the Site after any changes become effective constitutes your acceptance of the revised 

Terms. If you do not agree with the updated Terms, you must discontinue use of the Site.

10.1 Governing LawThese Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.

10.2 Dispute ResolutionAny dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be submitted to good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in Monmouth County, New Jersey. You waive the right to participate in any class action or class-wide arbitration.

10.3 ExceptionsNothing in this Section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to protect intellectual property rights or prevent immediate harm.

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be deemed severable from these Terms and will not affect the validity or enforceability of the remaining provisions.

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Site, constitute the entire agreement between you and Quantum Insurance with respect to your use of the Site and supersede all prior agreements, understandings, and representations.
